Noshir Dadrawala will not attend meeting called by BPP Chairman Yazdi Desai on intervening in the Calcutta case



Bombay Parsi Punchayet (BPP) trustee Noshir Dadrawala has stated that "Neither the BPP nor The Federation of the Parsi Zoroastrian Anjumans of India should intervene in the Calcutta case.

"With the greatest of respect to all, including Yazdi Desai (BPP Chairman) from the legal point of view, 'An intervener (like the FPZAI) cannot raise points which are not canvassed by the petitioners in the pleadings' (See AIR 1974 SC Pg. 962).

"Also, in St. Xaviers College Vs State of Gujarat: (AIR 1974 SC 1389) the court has stated: 'The settled practice of the Supreme Court is that an intervener is not to raise contentions which are not urged by the petitioners'

"In my considered opinion neither BPP nor FPZAI should get into this. I will not be attending the meeting on matter of principle.

"It was my promise to the electorate (and my colleagues Kersi Randeria and Zarir Bhatena also made that promise) before the elections in October 2015 that BPP will not interfere in matters of religion. As trustees we have to only discharge our fiduciary duties concerning the funds, assets and properties of the BPP. Matters of the religion are best left to our learned High Priests and scholars."
