By his order dated October 4, 2016, Justice Sharukh Kathawalla of the Bombay High Court directed the Charity Commissioner (CC) to determine the validity of Muncherji Cama’s (pictured) resignation from the board of trustees of the Bombay Parsi
Punchayet (BPP) within six weeks. The defendants were directed to file their affidavit in reply within a week of the order and the CC was instructed not to "grant any adjournments to either side unless absolutely necessary and only after recording reasons for the same.” As the matter has been pending before the CC since 2015, Cama had filed an originating summons (OS) in the High Court and another application before the CC against BPP chairman Yazdi Desai and the other BPP trustees.
Kathawalla also directed the defendants to file their reply to the OS within a period of eight weeks with the next hearing and final disposal scheduled for December 13.
Meanwhile at the 38th Metropolitan Magistrate Court at Ballard Pier, Judge Palaspagar passed an order on October 5 ordering further investigation in the Dady House transaction in the First Information Report (FIR) filed against erstwhile BPP chairman Dinshaw Mehta by former BPP trustee Khojeste Mistree. New evidence in the form of audio and video recordings was cited as a reason that necessitated a renewed probe. The next hearing has been reportedly slated for January 20, 2017.
