California resident Mehernosh Irani has locked horns with his deceased wife Goolnar’s brother Ardeshir (also Irani) and nephew Yohan in connection with her share in the family’s 100-acre property in Palghar, reported the Mid-Day (MD) of March 29, 2017. According to the report, Goolnar and her three sisters and two brothers were rightful heirs of the property, owned by her father Manecksha. Mehernosh and Goolnar were married in 1975, after which she acquired Canadian citizenship, "rarely visited India” and passed away in 1989.
In 2015, Mehernosh believed that Poona based Ardeshir and Yohan were planning to sell the entire property to a Bombay based developer and "approached the court in Palghar to stop this sale.” When the case was escalated to the Bombay High Court in the same year, Ardeshir and Yohan submitted a "registered will of Goolnar stating that she was handing over her share in the property to them (Ardeshir and Yohan).”
Alleging that the signature on the document was not Goolnar’s, Mehernosh filed a complaint of forgery with the Poona police; Ardeshir and Yohan, in the meanwhile filed for anticipatory bail on March 12 and furnished a will which they claimed to be Goolnar’s, but "with a wholly different signature to back their case.” The report states that their application was rejected on March 24, and in his order, additional sessions court judge is said to have pointed out… "the signatures of the executant (Goolnar) on the will do not match, and do not tally with the signature on her passport.”
The lawyers for Ardeshir and Yohan have dubbed Mehernosh’s case as "a pressure and harassment tactic.”
