A one-acre plot on Byramji Gamadia Road, set aside for a children’s park in 1991 and whose ownership is the subject matter of a dispute between Behram Gamadia and S. P. Seth, is now listed as a residential zone in the proposed development plan 2034 (DP 2034) according to the MumbaiMirror (MM) of June 8, 2017. The report states that the Bombay Municipal Corporation (BMC) had 25 years to acquire the plot "but did absolutely nothing,” resulting in the land getting de-reserved from its status of a children’s park.
Residents of Altamount Road, Peddar Road and Carmichael Road met the municipal commissioner Ajoy Mehta to save the plot from being taken over by builders. Throwing in his weight with the citizens’ organizations is actor Suneil Shetty who lives at Altamount Road. The report states that the residents heard back from the BMC’s Development Plan Department (DPD) on May 30 after the meeting with Mehta. The communication stated that the committee that "drafted the proposed DP 2034 did not take into consideration the residents’ objections on de-reserving the open space.” While Mehta reportedly asked the citizens’ organizations to locate an alternate property, Ramesh Kundanmal of the Cumballa Hill Citizens’ Forum stated that "this is not our job… The city fathers went to sleep at the wheel and jeopardized all the passengers in the bus.” Deputy chief engineer of BMC’s DPD told MM that "the local councilor can raise this issue on the floor of the house at BMC’s general body meeting… The corporation has powers to reject the de-reservation.” The property is in the custody of the court receiver of the Bombay High Court. The Daily News and Analysis (DNA) of May 2 had stated that the Japanese Consulate has offered to develop the plot as a Japanese garden.
